REMOVAL, BLACK LISTING OF DOWN GRADATION OF THE CONTRACTOR
A register of approved contractors shall be maintained in the respective circle in form (Annexure 1 ). The Superintending Engineer shall maintain an upto date consolidated list showing the names and addresses of all the contractors registered in his circle in class III to class VII. This consolidated list should be circulated by Superintending Engineer to all officers of the rank of Executive Engineer and above under Maharashtra Jeevan Pradhikaran
Similar, consolidated list of contractors registered in Class I, IA and II shall be maintained at Maharashtra Jeevan Pradhikaran level by Superintending Engineer (HQ) and circulated annually amongst all the officers of Maharashtra Jeevan Pradhikaran. Similarly, SE(HQ) will circulate the list of approved contractors in Class A to Class E of Electrical / Mechanical wing to all officers of Maharashtra Jeevan Pradhikaran of the rank of Executive Engineer and above.
Procedure of Removal or black listing or down gradation of the contractor.
The register shall be examined by the registering authority on the 1st July of each year and at other time, if found necessary on the report of specific failure or default by a contractor, while submitting tender or during execution of works or that the financial circumstances or technical capacity of contractor have so deteriorated that he ought to be removed from registered or black listed or placed in a lower class, he may proceed to do so after calling on the contractor to state within a stated time, as to why action as proposed should not be taken against him.
Yearly examination of performance.
The authority sanctioning the initial registration to take action against the contractor for their removal or downgrading. However, the Member Secretary will be the competent authority for blacklisting or removal from black list of the contractors. Action as taken should be intimated to all concerned. Whenever a contractor is removed from the approved class he will not be entitled to any refund of registration fee.

Any contractor whose relation is rejected, cancelled or downgraded by an officer who is competent to do so, may appeal against the order of such officer to the next highest competent Authority whose decision in the matter will be final.

A contractor approved in one Division will be allowed to tender for other Division provided he produces a certification for registration or renewal thereof from the originating Division that he is approved contractor in that Division for a particular category and such certificate is valid at the time of issue of tender form.

4.04
Two or more contractors of any class may combine and tender for a work costing to the amount upto which each individual contractor or the higher of the two limits if they are of different categories, are empowered to tender as per the original registration provided.

i) The combination of the contractor is as a whole and not individual partners and ii) They draw a registered partnership- deed and submit a copy thereof to the authority at the time of purchasing of the tender form. (Deed registered with Govt. Registrar) iii) In this connection Pradhikaran’s letter No. 1096/Regn.of Cont. may strictly followed.

The decision of the Member Secretary of the Pradhikaran for interpretation of any rule or sub-rule will be final.
